Versorgungsausgleich

Der Versorgungsausgleich ist die Angleichung der Rentenansprüche zwischen den Ehegatten. Er wird in der Regel bei einer Ehe, die länger als 3 Jahre gedauert hat, von Gesetzes wegen durchgeführt. Die Anzahl der Rentenansprüche wirkt sich auf die Kosten der Scheidung aus.

Auf den Versorgungsausgleich kann auch verzichtet werden. Dies muss jedoch im gegenseitigen Einvernehmen der Ehegatten erklärt oder in einer notariellen Urkunde vereinbart werden. Bei einer Ehe, die nicht länger als 3 Jahre gedauert hat, findet der Versorgungsausgleich nur statt, wenn dies ausdrücklich beantragt wird. Wird auf den Versorgungsausgleich verzichtet, verkürzt sich die Dauer des Verfahrens in der Regel erheblich.

What are the legal fees?

In the event of a divorce, we only charge the minimum fees according to the statutory provisions (see Lawyers’ Fees Act). This fee is determined using a publicly accessible table based on procedural values.

What is the procedure value?

The procedural value (also known as the value in dispute) depends, in addition to your net salaries, on what is to be dealt with in court. Everything that needs to be negotiated in the divorce process, such as assets, alimony, custody, etc., increases this procedural value.

Calculation example

Starting position:

You both earn 2,000 net.
Your statutory pension insurance should be clarified.
Only one attorney will be engaged.
The process value here is EUR 14,400.

You will incur the following costs (as of 05/2022):

Court costs = 648 EUR
Legal fees = 2,160 EUR
So the divorce would cost you 2,808 EUR.
